The terms and conditions applicable to the access and content of the website https://www.linguamundo.info and the contracting of LinguaMundo’s services are described below. By accessing or making use of the content of the LinguaMundo website and our services, the user and/or client agrees to be bound by these terms and conditions:
I. LINGUAMUNDO
LinguaMundo is the trade name registered with the IMPI under which Mr. Roel Blomsma, domiciled in Cancun, Quintana Roo, sworn translator, registered with the Federal Taxpayers Registry of the Tax Authorities of Mexico under the Simplified Trust Regime. In these terms and conditions, the name LinguaMundo refers to Mr. Roel Blomsma and vice versa and the pronouns: we, us, our and ours as well as the conjugation of verbs in the first person plural will be used to refer to such person. In our operation we resemble an agency that seeks to provide the best quality language services ro our clients and we collaborate with other language professionals, agencies, and organizations to achieve this goal.
II. USER AND/OR CUSTOMER
In these terms and conditions, any person who accesses the website https://www.linguamundo.info and the different pages of it and/or contracts the services of LinguaMundo through the aforementioned website or in any other way is considered client and/or user.
III. TRANSLATIONS
a. Certification and destination of the translation
We collaborate with sworn translators in the State of Quintana Roo and some other states of the Republic of Mexico. Our certified translations are legally valid in the state of Quintana Roo or in other states or countries where our collaborators are accredited as expert translators. If the client wishes to contract our services and use our translations in other states of the Republic of Mexico or abroad, he/she must verify with the authority with which he/she will start any procedure, if it accepts translations certified by translators accredited in Quintana Roo or in any specific state of the Republic of Mexico or abroad and/or if they require any specific certification, such as a notarial legalization or apostille. LinguaMundo cannot be held responsible for the rejection of our translations by authorities outside the State of Quintana Roo or abroad.
The client and/or user agrees that it is solely responsible for investigating whether the translation must be done by an translator from a specific state or country and whether the translation requires any notarization or apostille and waives any right to reimbursement in the event that its documents and/or the translations thereof are rejected for the reasons stated in this paragraph.
b. Legal validity and requirements of the original documents of the client and/or user
It is the client’s responsibility to investigate which documents must be submitted for processing. LinguaMundo only provides translations. We are not lawyers or paralegals. LinguaMundo is not responsible if the client and/or user’s original documents or translations thereof are rejected for not complying with the requirements indicated by the authorities to which the original documents and/or our translations are submitted for the reasons indicated in this section.
The client agrees that he/she is solely responsible for investigating which original documents to submit and whether these documents or the translations there of require notarization or apostille and waives any right to reimbursement in the event that his/her documents and/or our translations are rejected for the reasons stated in this paragraph.
c. Format and delivery of documents to be translated
LinguaMundo never asks for original documents. We only need a PDF of your documents in order to perform the translation. In the case of documents of few pages, the PDF will be attached as a certified copy of the original to the translation. In the case of multi-page documents, we do not attach a copy of the original to the translation and in any case it is the client’s responsibility to submit the originals with the translation.
It is the client and/or user’s responsibility to ensure that the documents to be translated are legibly and complete. LinguaMundo reserves the right to reject any document that is not complete or illegible and/or to ask the client to submit a better version of the document. Furthermore, LinguaMundo shall not be held responsible in the event that the original document delivered by the client is not complete and the client waives any right to reimbursement in the event that his/her documents and/or our translations thereof are rejected for the reasons indicated in this paragraph.
d. Quality
We make every effort to provide translations of the highest quality and, where appropriate, with the necessary legal validity within the jurisdiction in which our translators are accredited or as indicated in this clause.
e. Guarantee and refund policy in case of errors or quality problems
Prior to the physical delivery or shipment of the translations, we send the translation in PDF form to the client for review and approval. In case of errors, we will do our best to correct them and in case of doubts we will do our best to clarify them. If there is a problem with the quality of a translation, subject to LinguaMundo’s confirmation, the client has three months to indicate it and can demand that we correct it or can request a full refund of the amount deposited for the translation with quality issues. After the above mentioned period, the client will not be entitled to a refund and in the event that the client requests a correction of the translation after the above mentioned period, this will be charged separately.
f. Legal consequences in case of incorrect translations, translation quality issues or rejection of translations by any authority, company or organization
The client agrees that LinguaMundo offers him/her the possibility and sufficient time to review the translations and, if necessary, demand correction of errors or clarification of doubts, as well as a refund in accordance with the above paragraphs in case of errors or problems with the quality of the translations and therefore waives the right to sue LinguaMundo or the translator who performed the translation in case of legal consequences deriving from the translations with errors or in case translations are rejected by any authority, company or organization for reasons stated in these terms and conditions.
IV. ACCESS AND USE OF THE WEBSITE HTTPS://WWW.LINGUAMUNDO.INFO.
a. Website owner
The owner of the website is LinguaMundo.
b. Use of the website
The website is intended for customers in Mexico and is subject to the laws of this country. Clients and users from foreign countries are also welcome. If the customer resides in another country and decides to access the website, he/she does so at his/her own risk.
Access to the website by the customer is free of charge.
c. Modification and administration of the website
The owner reserves the right to make any changes to the website at any time and without prior notice and the client and/or user will accept such changes.
The administration of the website may be carried out by third parties, i.e. persons other than the owner, without affecting these terms and conditions.
d. Continuity and availability of the website
The owner does not guarantee the continuity and availability of the content of the website and/or the services offered therein, although it may take the necessary actions for the proper functioning of the website without any liability whatsoever.
e. Viruses, corrupted or malicious software and malware
The owner is not responsible for the software being free of errors that may cause damage to the software and/or hardware of the equipment from which the client and/or user accesses the website. Likewise, it shall not be liable for any damages caused by accessing and/or using the website.
f. Privacy and data protection policy
In accordance with the provisions of the Federal Law for the Protection of Personal Data in Possession of Individuals, the holder undertakes to take the necessary measures to ensure the security of the client and/or user and the information and documents sent to us, preventing the misuse of personal data provided by the client and/or user on the website.
The owner shall verify that the personal data contained in the databases are correct, true and current, as well as that they are used only for the purpose for which they were collected.
The use of personal data will be limited to the provisions of the Privacy Notice available at https://www.linguamundo.info/en/privacy-policy.
LinguaMundo reserves the right to make any modifications to the Privacy Notice and these Terms and Conditions at any time and without prior notice, according to its needs or changes in the applicable legislation and the client and/or user will accept such modifications.
The website involves the use of cookies which are small amounts of information that are stored in the browser used by the client and/or user such as login data, customer preferences, date and time the website is accessed, sites visited and IP address, this information is anonymous and will only be used to improve the website. Cookies facilitate navigation and make it more user friendly, however, the customer can disable them at any time from your browser on the understanding that this may affect some functions of the website.
g. Link Policy
The website may contain links to other Internet sites belonging to third parties for which LinguaMundo is not responsible.
h. Intellectual and industrial property policy of the website
The owner declares to have the intellectual and industrial property rights of the website, including images, audio or video files, logos, trademarks, colors, structures, typographies, designs and other elements that distinguish it, protected by Mexican and international legislation on intellectual and industrial property.
The client and/or user undertakes to respect the industrial and intellectual property rights of the owner and may view the elements of the website, store, copy and print them exclusively for personal use.
VI. APPLICABLE LAW AND JURISDICTION
The relationship between the client and/or user and the owner, as well as these terms and conditions, shall be governed by the laws applicable in Mexico.
LinguaMundo is not responsible for the improper use of the content of the website and/or its services or for the non-compliance with these terms and conditions.
